Welcome to Subtled Dynamics. These Terms and Conditions ("Terms") govern your use of the Subtled Dynamics website (subtleddynamics.sbs) and any related services, including booking makeup services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.

We reserve the right to change or modify these Terms at any time. You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your password. We encourage you to use a strong password (including upper and lower case letters, numbers, and symbols) for your account. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2.3 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose or in violation of any local, state, national, or international law
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services
• Using the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services
• Attempting to bypass any measures of the Services designed to prevent or restrict access
• Copying or storing any significant portion of the content on the Services
• Using any robot, spider, crawler, scraper, or other automated means to access the Services
• Introducing any viruses, trojan horses, worms, logic bombs, or other harmful material
• Encouraging or enabling any other individual to do any of the foregoing

3. Service Booking and Appointments

3.1 Booking Process

When booking a makeup service through our website or directly with our team:

• You agree to provide accurate and complete information about yourself and/or the service recipient
• You confirm that all health and allergy information provided is accurate and complete
• You acknowledge that appointments are subject to availability and confirmation

3.2 Appointment Confirmation

Your booking is not confirmed until you receive a confirmation email or message from us. We reserve the right to decline any booking request at our discretion.

3.3 Deposits and Payments

For certain services, particularly bridal and event makeup:

• A non-refundable deposit may be required to secure your booking
• The deposit amount will be clearly communicated before payment is requested
• The remaining balance is due on or before the day of service, as specified in your booking confirmation

3.4 Cancellations and Rescheduling

Our cancellation policy is as follows:

• For standard appointments: 48 hours' notice is required for cancellation or rescheduling without penalty
• For bridal services: 14 days' notice is required for cancellation or rescheduling without additional fees
• Late cancellations or no-shows may result in forfeiture of your deposit and/or a cancellation fee

We understand that emergencies happen. Please contact us as soon as possible if you need to cancel or reschedule due to unforeseen circumstances.

3.5 Late Arrivals

If you arrive late for your appointment:

• We will do our best to accommodate you, but your service may be shortened to ensure we stay on schedule for other clients
• The full service fee will still apply for shortened appointments due to late arrival
• Appointments more than 15 minutes late may be considered a no-show and subject to our cancellation policy

4. Intellectual Property

4.1 Our Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Subtled Dynamics, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as follows:

• Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your Web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution
• If we provide social media features with certain content, you may take such actions as are enabled by such features

4.2 Your Content

By sharing, submitting, or uploading any content to our Services (such as before/after photos, testimonials, or reviews):

• You grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods
• You represent and warrant that you own or have the necessary rights to grant us these rights

5. Health and Safety

5.1 Allergies and Skin Conditions

You agree to disclose any known allergies, sensitivities, or skin conditions prior to receiving our services. We cannot be held responsible for allergic reactions or skin irritations if you fail to disclose relevant information.

5.2 Patch Tests

For certain services or if you have sensitive skin, we may recommend a patch test 24-48 hours before your appointment. If you decline a recommended patch test, you assume all responsibility for any adverse reactions.

5.3 Medical Conditions

Please inform us of any medical conditions that may affect the service we provide. We reserve the right to refuse service if we believe it may negatively impact your health or safety.

5.4 COVID-19 and Infectious Diseases

We adhere to all current health and safety guidelines regarding infectious diseases. By booking our services, you agree to comply with our health and safety protocols, which may include:

• Health screening questions
• Temperature checks
• Mask requirements
• Rescheduling if you are experiencing symptoms of infectious illness

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall Subtled Dynamics, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims, damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using our Services during the 12 months prior to bringing such claim.

These limitations do not apply to liability that cannot be excluded or limited by applicable law, such as liability for personal injury caused by our negligence.

You agree to defend, indemnify, and hold harmless Subtled Dynamics, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Services
• Your violation of any rights of a third party
• Your violation of any applicable laws, rules, or regulations

8. Third-Party Links

Our Services may contain links to third-party websites or services that are not owned or controlled by Subtled Dynamics. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You further acknowledge and agree that Subtled Dynamics shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Dispute Resolution

Any disputes arising out of or related to these Terms or the Services shall be resolved through the following process:

2. If the matter cannot be resolved through direct communication, either party may request mediation through a mutually agreed-upon mediator
3. If mediation is unsuccessful, the dispute shall be resolved through arbitration in accordance with the rules of the London Court of International Arbitration

This dispute resolution process does not prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Services.

12. Changes to Services

We reserve the right to withdraw or amend our Services, and any service or material we provide via the Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services are unavailable at any time or for any period.
